Please read these Terms of Service ("Terms") carefully before using The Cognitive Index platform ("Service") operated by The Cognitive Index ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Service Description

The Cognitive Index is a tool provider that offers AI-powered resume analysis, keyword extraction, and automated job search aggregation services. We are not a recruitment agency, employment agency, or staffing firm.

We expressly do not guarantee:

Job placement or employment of any kind
Interview invitations or callbacks from employers
Accuracy, completeness, or availability of job listings
Specific number of job matches or search results
Response from any employer or recruiter

The Service provides tools to assist your job search. Employment outcomes depend on factors entirely outside our control, including but not limited to: employer decisions, market conditions, your qualifications, and third-party platform availability.

2. Consumable Digital Services

All services provided through The Cognitive Index, including but not limited to resume scans, AI keyword extraction, and job searches, are classified as consumable digital services.

When you initiate a resume scan or job search:

The service is immediately and irreversibly consumed
Third-party API costs are immediately incurred and cannot be reversed
Server-side processing begins instantly upon request initiation
The digital service cannot be "returned," "undone," or "refunded"

By using the Service, you acknowledge and agree that these are consumable digital services subject to our Refund Policy.

3. Usage Limits and Quotas

The Service enforces strict usage limits to ensure fair access and manage third-party API costs:

Job searches are limited to a specified number per rolling 7-day period
Unused quota does not roll over to subsequent periods
Quota limits are subject to change with notice

Circumvention of usage limits constitutes a material breach of these Terms. Prohibited activities include:

Using scripts, bots, or automated tools to bypass limits
Creating multiple accounts to obtain additional quota
Sharing account credentials to circumvent per-user limits
Any other attempt to bypass technical restrictions

Violation of usage limits results in immediate account termination without refund.

4. Third-Party Data and Scraping Disclaimer

The Service aggregates job listing data from publicly available third-party sources, including but not limited to LinkedIn, Indeed, Google Jobs, Glassdoor, and other job platforms.

The Cognitive Index is:

Not affiliated with any third-party job platform
Not endorsed by any third-party job platform
Not responsible for the accuracy, availability, or completeness of third-party data

We expressly disclaim responsibility for:

Expired, closed, or filled job listings
Broken links or inaccessible job postings
Inaccurate salary information, job descriptions, or company details
Jobs that are no longer available when you attempt to apply
Discrepancies between aggregated data and source listings

All third-party data is provided "AS-IS" without warranty of any kind.

5. AI Processing Disclaimer

The Service utilizes artificial intelligence and machine learning technologies for resume parsing, keyword extraction, and job matching. You acknowledge and agree that:

AI output is probabilistic and may contain errors, omissions, or misinterpretations
AI may fail to extract or may incorrectly interpret information from your resume
Job match scores and recommendations are algorithmic suggestions, not guarantees
You are solely responsible for reviewing and validating all AI-generated content

The Company is not liable for missed opportunities, incorrect interpretations, or any decisions made based on AI-generated content. You agree to independently verify all information before relying on it for job applications or career decisions.

6. Force Majeure / Platform Changes

The Service depends on third-party platforms and APIs that are outside our control. The following events constitute Force Majeure and do not entitle you to any refund, credit, or compensation:

Third-party platforms implementing anti-scraping measures
API access restrictions, rate limits, or policy changes by third parties
Third-party platform downtime, maintenance, or service interruptions
Changes to third-party data structures, formats, or availability
Legal or regulatory actions affecting data access
Natural disasters, pandemics, or other acts of God

No refunds will be issued for service interruptions caused by Force Majeure events.

7. Chargeback and Abuse Protection

By using the Service and submitting payment, you agree to the following:

You waive the right to initiate chargebacks for any completed server request or consumed digital service
Filing a chargeback for a legitimately provided service constitutes fraud

Consequences of filing an illegitimate chargeback:

Immediate and permanent account termination
Permanent ban from the platform
Collection action for the disputed amount plus administrative fees
Reporting to fraud prevention databases

If you have a legitimate billing concern, you must contact our support team before initiating any dispute with your payment provider.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, employment opportunities, or goodwill
The Company's total aggregate liability for any claims arising from or related to the Service shall not exceed the amount paid by you in the one (1) month period immediately preceding the claim
The Company is not liable for any actions, decisions, or outcomes resulting from your use of the Service

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

9. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Fraudulent or illegal activity
Abuse of the Service or support systems
Chargebacks or payment disputes
Circumvention of usage limits

Upon termination, your right to use the Service ceases immediately. No refunds will be issued for terminated accounts.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which The Cognitive Index operates, without regard to its conflict of law provisions.
